None Of Your Business Gun Update

Posted on December 18, 2008 at 9:21 am

Say Uncle with some big news:

The Tennessee Department of Safety has sent out letters telling instructors that teach the handgun carry course to fill out this roster. This roster records information about the gun used to take the course, including model, serial number and whether or not it belongs to the student. I received this info from a forwarded email sent out by the Tennessee Firearms Association, Inc., who notes that Nothing in the statutes authorize or direct the Department of Safety to collect or require this information.

A little civil disobedience leading to a court test might be in order…hmmm…wondering if a declaratory judgment right now might be in order.

Better be prepared to take it all the way to the Tennessee Supreme Court though — Bredesen’s administration is still trying to collect the drug tax found unconstitutional months ago, pending appeal.

According to the Official Safety Dept. Release on Registering Guns used in Permit Classes, it is stated that “The intent of the new form was to verify participation in the handgun safety course.” If this is true, then what is the purpose of faxing the form within 24 hours of the completion of the course as well as mailing the hard copy? Would one or the other not suffice? In these economic times, it seems the redundancy is not only economically ridiculous, it is obviously a waste of time for those who must do this. The roster that was implemented previously asked for names and TN DL#’s. Why would that form be sufficient?
