Palin Baits The Hook

Chris Sanders is none too pleased that Sarah Palin has decided to unburden her soul on the subject of gay marriage:

Her position shouldn’t come as much of a surprise given her remarks during the vice presidential debate. But it’s still disappointing. I have to give some credit to John McCain. He’s a federalist who thinks the issue ought to be decided at the state level, and I don’t think he wants this campaign to be about bullying the GLBT community or immigrants or any other outsider group. But someone in the campaign has decided that it would be a good idea to allow Palin to talk about the issue. The next two weeks are going to be rough.

    The “full faith and credit clause” (Article IV, Section 1) of the US Constitution makes a “federalist” solution impossible.

    See “Nevada” & “divorce” & “1960s” for an instructive bit of history.

    The US Constitution requires all states to give full faith and credit to the official acts of all other states. If a couple get married in Ohio, the US Constitution requires the state of TN to recognize the couple as married.

    So, what solution would you propose for states where the citizens do not wish to recognize gay marriage?

    In the interpretation of this clause of the Constitution, the Courts have allowed public policy exceptions. At the moment, full faith and credit isn’t helping us achieve marriage equality. It may some day, as may the 14th Amendment’s equal protection clause. But we have a federalist solution to marriage for the time being. And I find that superior to the direction in which Palin wants to go.
